(Crime No.304 of 2020) ..Respondent PRAYER: Criminal Original Petition filed under Section 482 of Cr.P.C, praying to direct the learned Sessions Judge, (Special Court for Exclusive Trial of cases registered under the SC/ST Prevention of Atrocities) Act 1989, Cuddalore District, to accept the surrender of the petitioner herein concerned in Crime No.304 of 2020 on the file of Inspector of Police, Kurinjipadi Police Station, Cuddalore District, and consider the bail application of the petitioner on the same day in Cr.No.304 of 2020 on the file of the respondent police.

O R D E R

This petition is filed for a direction to the learned Sessions Judge, (Special Court for Exclusive Trial of cases registered under the SC/ST Prevention of Atrocities) Act 1989, Cuddalore District, to accept the surrender and consider the bail application of the petitioner on the same day in Cr.No.304 of 2020 under Section u/s.g 294(b), 323, 324 of I.P.C. and 3(1)(r), 3(1)(s) of SC/ST Act, pending on the file of the respondent police, since the offences are pertaining to the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989.

2. Heard the learned Government Advocate (Criminal Side). https://hcservices.ecourts.gov.in/hcservices/

3. In view of the specific bar under Section 18 of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 and also taking into consideration of the possibility of misusing the pious intention of the Parliament against innocent persons, there shall be a direction to the learned Sessions Judge, (Special Court for Exclusive Trial of cases registered under the SC/ST Prevention of Atrocities) Act 1989, Cuddalore District, to consider the petitioner's bail application on the same day of hisr surrender in connection with Kurinjipadi P.S.Cr.No.304 of 2020 and pass appropriate orders in accordance with law.

4. With the above observations, the Criminal Original Petition is ordered.
