ORDER

This Writ Petition has been filed, praying for the issuance of a Writ of Mandamus, to consider the petitioner's representation sent on 12.01.2024, for a fresh assessment with 100 percent increase in the Property Tax instead of 269 percent increase.

According to the petitioner, he is the owner of the property in the East Zone of the Coimbatore District, Ward No. 36 (old No. 08), Door No. 10, Door Noll/1, Door No. 10/2, Door No.10/3 Kalappatti Village. He has been paying taxes regularly. While so, the above mentioned property's taxes were assessed vide Tax Assessment No. 3620128 for door No.10, Tax Assessment No. 3620129, for Door No.10/1, Tax Assessment No. 3620130, for Door No.10/2 at the rate of Rs.3499/- and Tax Assessment No. 3620128, for Door No.10/3, was Rs.5,649/- till the first half of the year 2020. While so, the grievance of the petitioner is that having done no modification or or restructuring to the buildings, the assessment were increased by an exorbitant 269% to the tune of Rs.14,599/- for Door No's: 10, 10/1, 10/2 and Rs.20,844/- for Door No.10/3, respectively, which is against the G.O.Ms.No.73 dated 19.07.2018 and GOMs.No.52 dated 30.03.2022.

3. The learned counsel for the petitioner would submit that the petitioner

made a representation on 12.01.2024 to the respondents, seeking to reassessment of the property tax, but there was no response from the respondent and hence he would urge this Court to direct the respondents to consider the representation of the petitioner and pass appropriate orders after affording an opportunity to the petitioner.

Considering the facts of the case and the limited prayer sought for in the Writ Petition, this Court, without delving into the merits of the matter, directs the respondents to consider the representation, dated 12.01.2024 and dispose of the same in accordance with law, after affording an opportunity to the petitioner, within a period of four weeks from the date of receipt of a copy of this order.
