PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to pay interest amounts to the petitioner for the belatedly paid Service Gratuity, Provident Fund, Leave Salary and Commutation of Pension at the rate of 6% per annum for 20 months 1/5
of delayed payment in the light of the judgment passed by this Hon'ble Court on 23.10.2024 in W.P.No.30766 of 2024.

ORDER
The writ petition is filed for the relief set out below: "directing the respondents to pay interest amounts to the petitioner for the belatedly paid Service Gratuity, Provident Fund, Leave Salary and Commutation of Pension at the rate of 6% per annum for 20 months of delayed payment in the light of the judgment passed by this Hon'ble Court on 23.10.2024 in W.P.No.30766 of 2024."
2. It is the case of the petitioner that she had worked as Senior Superintendent in the respondent-Corporation and had retired from service on 31.05.2024. The respondents who are bound to settle the retirement benefits including Service Gratuity, Provident Fund, Leave Salary and Commutation of Pension Amount to the petitioner on the date of his retirement, had paid the 2/5
same only on 02.12.2025, with a delay of 20 months. Therefore, it is the petitioner's contention that the respondents are legally bound to pay interest to me. The petitioner had made a representation on 20.02.2026, to the respondents to pay the interest at the rate of 12% p.a., for the belated payment of her Earned Leave Salary, Gratuity Amount and Pension Commutation Amount. Since the same was not considered to date, the petitioner is before this Court.
3. Heard the learned Counsel on either side and perused the materials available on records.
4. Admittedly, the Earned Leave Salary, Gratuity Amount and Pension Commutation Amount has been paid to the petitioner belatedly for no fault of her. Hence, the petitioner is entitled to the interest on the same. Therefore, a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Earned Leave Salary, Gratuity Amount and Pension Commutation Amount within a period of one (1) month from the date of receipt of a copy of this order.
