ORDER

The writ petition has been filed in the nature of a mandamus seeking a direction against the respondent/Medical Services Recruitment Board, Chennai, to conduct verification of the certificates of the petitioner for considering the

petitioner for the post of Physiotherapist, Grade-II, under the BC-PSTMWomen Category, by taking into consideration the certificates for having studied in Tamil medium, dated 28.10.2024, 29.10.2024 and 30.10.2024 issued with reference to Section 2(d) of PSTM (Amended) Act-2020. 2.In the affidavit filed in support of the writ petition, it had been contended that the petitioner had completed her schooling in Tamil medium and continued Higher Education and completed Bachelor of Physicotherapy from Tamil Nadu Dr.MGR Medical University in August 2004. Petitioner was eligible to be appointed to the post of Physiotherapist. Petitioner had applied to that particular post consequent to a notification issued by the respondents on 18.10.2024. The total number of posts was initially 47 and subsequently, two further posts were added making it 49.

It was also stated that reservations as provided under the Act for the PSTM candidates were also provided. Two posts were reserved, one for general and another for women. The petitioner had however not specified that she should be considered exclusively under PSTM category since, it is contended by her that there are no courses in Tamil medium offered in Bachelor of Physciotherapy.

obtained 38 marks in the Tamil eligibility test out of 50 and 69 marks out of 100 in the other subject matters. Petitioner was however not selected. It is under those circumstances that the petitioner had filed this writ petition contending that she should be considered under the PSTM category since she studied her school education in Tamil medium.

3.Instructions were sought from the respondents and the learned standing counsel stated that consequent to the notification, for 47 vacancies, 8772 applications had been received. After the examination process, 81 candidates were called for certificate verification. Seven candidates who were claiming PSTM reservation even in the initial applications were also called for certificate verification. But, a letter had been received from the Director of Medical Education and Rural Services stating that Bachelor of Physicotherapy is not available in Tamil Medium. Therefore, those who had applied for PSTM were not accommodated under that particular category, but mingled with the regular list. It is contended that they cannot claim under the PSTM category. Petitioner admittedly had not studied in Tamil medium the Bachelor of Physicotherapy course.

4.With respect to the cut off marks, the petitioner would then come under BC General Women and the last candidate had secured 81 marks and the petitioner had secured 69 marks. Unfortunately, the petitioner had not come within the zone of selection. This Court would only wish her well in her future endeavours, but, in this particular examination process, she had not secured the marks required for consideration for selection. 5.The writ petition stands dismissed. No Costs.
