ORDER

The writ petition has been filed in the nature of a mandamus seeking consideration of the benefit of settlement reached under section 12(3) of the Industrial Disputes Act, 1947 on 04.01.2018 to the petitioner also.

2. It is contended that the petitioner had retired from service on attaining the age of superintendent on 31.05.2015. It is further contended that the aforementioned settlement reached under Section 12(3) of the Industrial Disputes Act, 1947 would also be applicable to the petitioner herein.

3. The respondents may examine that particular claim and if the petitioner is eligible may grant amount for which the petitioner is eligible. The petitioner is also entitled for interest of 6% per annum from the date of settlement till the date of disbursement. The said exercise must be completed within a period of four months from the date of receipt of a copy of this order.

4. The writ petition stands disposed of. There shall be no order as to costs.
