Respondents Prayer: Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Mandamus, directing the respondents to correct the petitioner's date of birth in all the relevant records including the Service Register as 23.06.1969 instead of 01.06.1968 as per the Birth Certificate dated 30.10.2009 (Registered on 01.07.1969) by considering the petitioner's application dated 27.02.2010.

ORDER

The writ petition has been filed in the nature of a mandamus seeking a direction to correct the date of birth of the petitioner as 23.06.1969 which had been entered, according to the petitioner, wrongly, as 01.06.1968. 2.The petitioner had given an application on 27.02.2010 in this regard. The petitioner had joined services on 27.09.2007 as BT Assistant (Maths) in the Government Higher Secondary School, Sellampattu, Kallakurichi District. It has been stated that within a period of three years, the petitioner had given a representation on 27.02.2010.

3.The respondents may first verify whether that particular representation had actually been given by the petitioner and received by the respondents. Thereafter, the respondents may further examine the documents relied on by the petitioner and examine which document could be considered as primary document to indicate the date of birth of an individual. The respondents may further examine whether the original of the said document had been produced. Let an enquire be conducted in accordance with the provisions. The respondents, if the application is available, commence and complete the investigation within a period of six months from the date of receipt of a copy of this order.
