Writ Petition , filed under Article 226 of the Constitution of India, for issuance of Writ of Mandamus, directing the respondents to issue necessary orders to ensure extension of reservation of quota/seats for wards of (Ex. CAPF), (Central Armed Paramilitary Forces) on par with Ex. Servicemen (Defence Force) in Higher/Professional/Technical Education Courses, as per Office Memorandum No.27011/100/2012 R&W dated 23 November, 2012 issued by Ministry of Home Affairs, Government of India, within a time frame as may be fixed by this Court as to enable the wards of retired personnel from paramilitary forces to avail

reservation in admission to Higher/Professional/Technical Education Courses from the academic year 2017-2018. For Petitioner : Mr.R. Veeramani For Respondents : Mr. Gandhiraj Government Pleader (Puducherry)

O R D E R

(Order of the Court was delivered by T.S.Sivagnanam, J.,) Heard Mr.R. Veeramani, the learned counsel appearing for the petitioner and Mr. Gandhiraj, the learned Government Pleader appearing for the respondents. The learned counsel appearing for the petitioner submits that, though the petitioner seeks for a positive direction to issue necessary orders for reservation of quota/seats for wards of former Central Armed Paramilitary Forces personnel, the learned counsel would submit that the petitioner would be satisfied that, if a direction is issued upon the respondents to consider the petitioner's representation, dated 28.04.2017. The learned counsel has also drawn our attention to the order passed by the Hon'ble First Bench of this Court, in the case of P. Santhakumar Vs. Secretary to Govt.

Department of Health and Family Welfare, Chennai and others), in W.P.No.3140 of 2017, dated 08.02.2017, wherein, a similar prayer, sought for by the retired personnel from Para Military Forces was considered and the said Writ Petition was disposed of, by order, dated 08.02.2017. Mr. Gandhiraj, the learned Government Pleader appearing for the respondents would submit that, the first respondent will consider the petitioner's representation and pass orders on merits and in accordance with law, and prays that reasonable time may be given for its disposal.

In the light of the above, this Writ Petition is disposed of, by directing the first respondent to consider the petitioner's representation, dated 28.04.2017, and pass appropriate orders on merits and in accordance with law, within a period of eight weeks from the date of receipt of a copy of this order. No costs. Consequently, connected Writ Miscellaneous Petition is closed.
