ORDER

This writ petition has been filed seeking for a direction to the first respondent to correct the FMB sketch for the properties morefully disclosed in the affidavit filed in support of this writ petition in conformity with the registered title deeds and the old revenue records standing in the name of the petitioner based on the petitioner's representation dated 30.01.2026 within a time frame to be fixed by this Court.

2. The petitioner has filed supporting documents in support of the prayer sought for in this writ petition, which includes the patta and title deeds standing in his name for the subject property. According to the petitioner, the FMB sketch pertaining to the petitioner's patta land, which needs to be corrected discloses 'Nilaviyal Pathai'. According to the petitioner, the entire land, which is the subject matter of patta No.339 issued in favour of the petitioner, is absolutely owned by the petitioner and he is in possession of the same. Therefore, according to the petitioner, the FMB sketch for the property has to be corrected. The petitioner had given a representation on 30.01.2026 to the first respondent to correct the FMB sketch in conformity with the old revenue records as well as the registered title deeds standing in the name of the petitioner. Since the said representation has not been considered, the petitioner has filed this writ petition.

3. Mr.C.Jayaprakash, learned Government Advocate, accepts notice on the respondents.

4. Learned counsel for the petitioner also drew the attention of this Court to the photograph of the subject land, which reveals a pathway. The petitioner claims that the said pathway belongs to the petitioner and it is a private pathway. However, as per the FMB sketch, the said pathway, according to the petitioner, has been classified as 'Nilaviyal Pathai'. Learned counsel, on

instructions, would submit that the petitioner is the owner of the property from the year 1980 onwards.

No prejudice would be caused to the first respondent if the petitioner's representation dated 30.01.2026 seeking for correction of FMB sketch is considered on merits and in accordance with law after giving due consideration to the supporting documents produced by the petitioner within a time frame to be fixed by this Court. However, till final orders are passed, the petitioner's interest will have to be protected.

Accordingly, this Court directs the first respondent to pass final orders on the petitioner's representation dated 30.01.2026 seeking for correction of the FMB sketch pertaining to the survey Nos.208/2 and 208/5 at Vadugam Village, Rasipuram Circle, Namakkal District, in conformity with the registered title deeds and old revenue records, on merits and in accordance with law, within a period of twelve (12) weeks from the date of receipt of a copy of this order. Till final orders are passed, status quo, as on today, shall be maintained by the respondents.
