ORDER

This writ petition has been filed, seeking for a direction to the respondents 3 and 4 to consider the petitioners representation dated 10.12.2025.

2. According to the petitioner, the fifth respondent is not entitled for grant of patta in view of the pendency of the Civil Suit in O.S.No.12 of 2024 on the file of the Principal District Munsif Court, Attur.

3. The apprehension of the petitioner is that despite objections raised by the petitioner through his representation dated 10.12.2025, the respondents 3 and 4 may issue patta for the subject property in favour of the fifth respondent.

4. Necessarily, the respondents 3 and 4 will have to consider the objections raised by the petitioner through his representation dated 10.12.2025 before deciding any application filed by the fifth respondent, seeking for grant of patta in his name for the subject property.

5. Since no adverse orders are passed against the fifth respondent, notice to the fifth respondent is dispensed with by this Court.

6. No prejudice will be caused to any of the parties, if a direction is issued to the respondents 3 and 4 to consider the objections raised by the petitioner through his representation dated 10.12.2025 before deciding any application filed by the fifth respondent, seeking for grant of patta in his name for the very same property. In case, the respondents 3 and 4 decide to reject the petitioner's objections given through his representation dated 10.12.2025, the same has to

be rejected by passing a speaking order after due consideration of the objections raised by the petitioner as well as the supporting documents produced by the petitioner including the petitioner's contention that a Civil Suit in O.S.No.12 of 2024 is pending on the file of the Principal District Munsif Court, Attur.

For the foregoing reasons, this writ petition is disposed of by directing the respondents 3 and 4 to consider the objections raised by the petitioner through his representation dated 10.12.2025 for the grant of patta in the name of the fifth respondent for the subject property on merits and in accordance with law while deciding any application submitted by the fifth respondent seeking for grant of patta in his name for the very same property. If the respondents 3 and 4 decide to reject the objections of the petitioner, the respondents 3 and 4 will have to pass a speaking order with regard to the petitioner's objections while granting patta in favour of the fifth respondent.
