The petitioners/ 9th and 11th accused, who apprehend arrest at the hands of the respondent police for the offence punishable under Sections 120(b), 468, 471, 420 of IPC in Crime No. 46 of 2014, on a complaint given by the State Bank of India, seek anticipatory bail.

2. It is contended by the learned counsel for the petitioner that the petitioner availed vehicle loan of Rs.4/- lakhs and agree to pay the same in 60 equal monthly installments. A suit was also filed against the petitioners for non repayment of the loan which is pending before the III Additional Sub Court, Coimbatore. It is however contended that the documents relating to the vehicle had been misplaced by the petitioners and somebody else had seized away the documents. 1/2 https://www.mhc.tn.gov.in/judis

On the other hand, it is the contention of the learned Government Advocate (Crl.Side) appearing for the respondent that, by using forged documents, loans were obtained under the guise of purchasing vehicle. In this manner, to a total amount of Rs.1.93 crores had been sanctioned to various individuals. The petitioners herein had benefited to a sum of Rs.4/- lakhs and Rs.9/- lakhs respectively. They had obtained the loan on the basis of forged documents.

4. In view of this fact, it would only be appropriate that the investigation is conducted sine it also involves several other accused and a total amount is at Rs.1.93 crore. This Criminal Original Petition does not lie and accordingly, it is dismissed.
