This Civil Miscellaneous Petition has been filed to condone the delay of 630 days in filing the above appeal.

2. Heard the learned counsel for the petitioner and the learned counsel for the respondent Nos.1&3.

3. The learned counsel for the 3rd respondent has no serious objection to allowing the application.

4. The 1st petitioner would aver that, due to her illiteracy, she was not aware of the time limit prescribed for preferring an appeal and had no knowledge about the procedure for filing the same. She would further aver that, owing to financial constraints, a delay of 630 days has occurred in preferring the Civil Miscellaneous Appeal.

5. Accepting the averments made by the petitioner in the affidavit enclosed with the petition, this Court is inclined to allow this Civil Miscellaneous Petition subject to the condition that the interest for the delay period of 630 days alone shall stand waived.
