Prayer: Application filed under Order XIV Rule 8 of the Original Side Rules read with Order XXVI (9) & (10) read with Section 94 (e) of the Code of Civil Procedure praying to pass an order of interim Mandatory Injunction directing the 2nd respondent to open the locker No.577 with Canara Bank, Mandaveli Branch, Chennai 600 028 in the presence of a Senior Officer and / or an Advocate Commissioner and in the presence of the 1st applicant / 1st plaintiff and the 1st respondent / 1st defendant and take an inventory of the jewellery, documents securities and other articles kept in the said locker by the 1st applicant / 1st plaintiff, more fully described in the schedule appended to the Judge's summons. ORDER

The learned counsel for the respondent would submit that the respondent has no objection to the said application being allowed. The learned counsels have also submitted that on 21.07.2020 the 1st plaintiff accompanied by the 4th plaintiff, Indira Ramakrishnan and the 2nd 2/5

defendant shall visit the Bank. The 2nd defendant who is in possession of the locker key shall open the locker. Respective lawyers or their Junior would be present at the Bank and the 2nd respondent shall open the locker and inventory of the contents of the locker shall be made and each party shall maintain the copy which shall be countersigned by the parties as well as respective counsels / Junior of the counsels. They have no objection to the locker key continuing in the custody of the 2nd respondent thereafter.

2. Post the matter on 13.08.2020 under the caption "For Reporting Compliance".
