This application has been filed under Section 9 of the Arbitration and Conciliation Act, 1996, seeking for an order of injunction restraining the respondent from transferring or alienating or encumbering the Scheduled property till the realization of the arbitral award amount.

2. Since the property, which is the subject matter of this application has already been alienated, this application has now become infructuous. The learned counsel for the applicant is not pressing this Page No.1 of 3

application in view of the said fact, however, he seeks liberty to file a fresh application seeking for proper interim relief against the respondent.
