With the consent of the learned counsel appearing on either side, the Writ Petition is taken up for final disposal at the admission stage itself.
2.The petitioner has come forward with this Writ Petition for issuance of a writ of mandamus to direct the first and third respondents to pay the back wages, increment and all other attendant benefits during the period of suspension and consider the representation submitted by him dated 06.12.2014. https://hcservices.ecourts.gov.in/hcservices/
3.The petitioner is working as B.T.Assistant in the third respondent School. He was placed under suspension based on the complaint given by his wife in the matrimonial dispute. Hence, the petitioner approached this Court by filing a writ petition in W.P.No. 14949 of 2014 and on the basis of the order passed by this Court dated 11.6.2014, he was restored to duty by an order dated 16.10.2014. Thereafter, the petitioner has made representations dated 01.12.2014 & 06.12.2014, for payment of wages for the period of suspension. Since no action has been forthcoming, the petitioner has filed the present Writ Petition for passing orders on the representations submitted by him.
4.Considering the limited scope of the prayer sought for by the petitioner, the second respondent is directed to consider the representations submitted by the petitioner dated 01.12.2014 & 06.12.2014, and pass appropriate orders on merits and in accordance with law, within a period of twelve weeks from the date of receipt of a copy of this order.
