(The Order of the Court was made by M.JAICHANDREN J,) This Habeas Corpus Petition has been filed to produce the detenue, namely, Amudha, who is said to be 20 years of age, before this Court and to hand over her custody to the petitioner. https://hcservices.ecourts.gov.in/hcservices/
2. It has been stated that the detenue has been missing from her home, from 21.12.2014. The petitioner had lodged a complaint before the second respondent Police, on 21.12.2014, stating that the third respondent had abducted the detenue. The petitioner had also given a complaint to the first and the second respondents through registered post, on 22.12.2014. However, as no action had been taken by the first and the second respondents based on the complaint lodged by the petitioner, he has preferred the present Habeas Corpus Petition before this Court.
3. Today, when the matter has been listed for hearing, the second respondent Police had produced the detenue before this Court. On enquiry, the detenue had stated that she had married the third respondent, who is her aunt's son, on 21.12.2014, at the Shiva Temple, Udayarpalayam Taluk, Ariyalur District. The detenue had also stated that she had voluntarily left her home and had married the third respondent, who is 22 years of age and a mason by profession. On enquiry, the third respondent had reiterated the statements made by the detenue. The detenue had further stated that she is willing to go along with the third respondent, as she had married him.
4. In such circumstances, as the detenue is a major, she is permitted to go along with the third respondent, as per her wish. As no further orders are necessary, we find it appropriate to close the Habeas Corpus Petition. Accordingly, the Habeas Corpus Petition stands closed.
