PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondent to pay the difference in gratuity and difference in leave salary along with interest @ 10% in terms of the 14th Wage Revision Settlement signed under Section 12(3) of the I.D. Act, dated 24.08.2022, by considering the petitioner's representation dated 16.10.2025 within the stipulated period as fixed by this Court For Petitioner :

ORDER

The writ petition has been filed seeking a mandamus to direct the respondent to pay the difference in gratuity and difference in leave salary along with interest @ 10% in terms of the 14th Wage Revision Settlement signed under Section 12(3) of the I.D. Act, dated 24.08.2022, by considering the petitioner's representation dated 16.10.2025 within the stipulated period as fixed by this Court.

2. It is the case of the petitioner that he had joined as Driver in the respondent-Corporation on 01.12.1996, and was superannuated on 30.04.2021. The petitioner would submit that 14th Wage Settlement was entered into between the petitioner Transport Corporation and Employees of the Corporation on 24.08.2022. As per the settlement, the persons who were in service from 01.09.2019 to 31.07.2022 would receive the revised monetary benefits in terms of 14th Wage Settlement. The petitioner had retired only on 30.04.2021. However, 14th Wage Settlement was signed later, and it cannot deprive the petitioner for getting the benefit.

3. In view of the above, the respondent is directed to examine the 2/4

request of the petitioner and extend the benefit of the 14th Wage Settlement to the petitioner, if otherwise eligible, within a period of three weeks from the date of receipt of copy of this order.
