PRAYER : The Writ Petition is filed under Article 226 of the Constitution of India for the issuance of a Writ of Declaration to declare that the issuing Transfer Certificate to the petitioner and thereby expelling the student from the third respondent school is illegal and invalid and consequently to direct the third respondent to cancel the Transfer Certificate and to permit the student to continue in the second standard for the present academic year. ORDER
The present Writ Petition has been filed seeking the issuance of a Writ of Declaration to declare that the issuance of the Transfer Certificate to the petitioner and the consequent expulsion of the student from the third respondent School are illegal and invalid and consequently to direct the third respondent to cancel the Transfer Certificate and to permit the student to continue in the second standard for the present academic year.
2. The learned counsel appearing for the petitioner submitted that the petitioner's father is a teaching staff of the second respondent. Due to the personal enmity, the petitioner / student was expelled from the third respondent School. Hence, the present Writ Petition has been filed with the aforesaid prayer.
3. The learned counsel appearing for the third respondent School submitted that the student is presently studying in the II standard in some other Private School. Therefore, the relief sought for in this Writ Petition has become infructuous. The same was also observed by this Court in Contempt Petition No.2973 of 2025 Accordingly, she prayed for appropriate orders.
4. In view of the above, this Court is of the considered opinion that the student is already studying in the II standard in some other Private School and therefore, there is no necessity to grant the relief sought in this Writ Petition. Accordingly, this Writ Petition is dismissed. There shall be no order as to costs. Consequently, connected Miscellaneous Petition is closed. 30-03-2026 Asi
