JUDGMENT

This Criminal Appeal has been filed against the judgment in S.C.No.120 of 2006 on the file of Additional District and Sessions Judge, Fast Track Court, Namakkal, dated 24.03.2008, thereby convicting the appellant for the offence under Section 366(A) of IPC and sentencing him to undergo Rigorous Imprisonment for five years and to pay a fine of Rs.5,000/-, in default of payment of fine to undergo Rigorous Imprisonment for one year for the offence under Section 366(A) of IPC.

2. The learned counsel appearing for the appellant submitted that while pending this appeal, the sole appellant/accused died on 19.05.2017.

3. The learned Government Advocate (Criminal Side) is also confirmed the same. He is also produced the certificate issued by the Village Administrative Officer, No.13, Periya Semoor - "A", Erode District, dated 23.07.2018, stating that the sole appellant Karuvayan @ Murugan @ Murugesan, S/o.Muthusamy died on 19.05.2017.

4. In view of the same, this Criminal Appeal is dismissed as abated.
