ORDER

Aggrieved by the order passed by the 2nd respondent granting approval in respect of the property in question, the petitioner is before this Court.

It is the case of the petitioner that the property bearing punjai Survey No.63/4, to an extent of 1.71 cents situated at Sandhavellur vilalge, Sriperumbudur Taluk, Kancheepuram District originally belonged to his father P.Louis in respect of which patta no.715 also stood in his name. The petitioner's mother P.L.Fathima Mary predeceased her father. After the demise of her father on 10.07.2006, the petitioner and other legal heirs of the deceased are in

absolute possession and enjoyment of the aforesaid property. Whileso, on 21.112007, one P.Lourdusamy created a fabricated registered settlement deed in favour his son who is the 8th respondent herein. Based on which, the 8th respondent had also obtained patta in his favour and is trying to interfere with the above property. Aggrieved thereby, the petitioner filed a suit in O.S.No.65 of 2021 on the file of the District Munsif Court at Sriperumbudur, Kancheepuram District and the same is pending. Further, the 7th respondent, by suppressing the above facts had approached the respondents 1 and 2 for approval to the layout. Despite the objections raised by the petitioner for such approval, the 2nd respondent without conducting a proper enquiry had granted approval vide the present impugned order dated 12.03.2021. Aggrieved by the same, the petitioner has come forward with the present Writ Petition.

Learned counsel appearing for the petitioner submitted that, with regard to the issue of title between the petitioner and the private respondent, the petitioner had earlier filed a Writ Petition challenging the provisional approval granted in favour of the private respondent with regard to the layout. However, since the petitioner had already instituted civil suit concerning very same subject property in O.S.No.65 of 2021 on the file of the District Munsif Court, Sriperumbudur seeks permission to canvass all the issues raised in the present Writ Petition before the civil court where the suit is pending. He also seeks permission to file an impleading petition and the Interlocutory Application

seeking interim injunction.

4. In the light of the aforesaid submission, this Writ Petition is dismissed with liberty to the petitioner to work out her remedies before the Civil court where the suit is pending. The petitioner is further granted liberty to file a fresh writ petition in the event of succeeding in the suit. There shall be no order as to costs.
