2. Captioned 'Criminal Miscellaneous Petition' [hereinafter 'Crl. MP' for the sake of convenience and clarity] has been filed with a 'condonation of delay' ['COD'] prayer qua appeal against acquittal. Even before COD prayer was acceded to, the appeal has been processed and numbered. In other words, Crl.A.SR.No.14903 of 2023 has been processed and it has now been assigned with Crl.A.No.411 of 2023.

3. We are informed that this has happened due to oversight and that it is only a matter of inadvertence. Making it clear that this is an exception, we ratify numbering of the appeal as we are convinced that the delay deserves to be condoned considering the facts and circumstances of the case.
