C.M.P.No.7000 of 2022 in S.A.No.1218 of 2011 C.V.KARTHIKEYAN,J.

This Civil Miscellaneous Petition has been filed to restore S.A.No.1218 of 2011 which had been dismissed for nonappearance on 30.03.2022. 2.In the affidavit filed in support of the said petition, the petitioner/appellant had stated that she was informed that the Second Appeal had been adjourned to 07.03.2022 for advancing arguments and for filing written arguments. It was stated that the written arguments have already been prepared. However, on the date, when it was actually listed, the counsel was engaged in another Court and therefore, he could not represent the Second Appeal and the same was dismissed for non-appearance.

3.In view of the above reasons, the Second Appeal is restored to file and the Civil Miscellaneous Petition is allowed.
