Petition filed under Article 226 of the Constitution of India for the issuance of writ of mandamus directing the respondent to pay the retirement benefits such as Gratuity, Earned Leave Salary, Commutation etc. payable to the petitioner with interest at the rate of 18% from 30.11.2012 the date of retirement. O R D E R

The petitioner worked as driver and on attaining the age of superannuation retired on 30.11.2012. There were no proceedings pending against the petitioner as on the date on which he retired from service. Even then he was not given retirement benefits. The petitioner submitted a representation on 20.11.2014 requesting the respondent to pay him all the statutory benefits, pursuant to the order of retirement. However, there was no follow up action taken by the respondent. The petitioner is therefore before this Court.

2. The respondent is directed to consider and dispose of the representation dated 30.11.2012 as expeditiously as possible and in any case within a period of two months from the date of receipt of a copy of this order. case, the petitioner is not responsible for the delay in disbursing the benefits.

3. The writ petition is disposed of with the above direction. No costs. Consequently, connected miscellaneous petition is closed.
