Respondents Prayer:- Writ Petition filed under Article 226 of the Constitution of India, 1950, praying to issue a Writ of Certiorarified Mandamus, calling for the records pertaining to the impugned suspension order in proceedings vide Na.Ka.No.A1/3297/2023, dated 23.11.2023, on the file of the second respondent herein, to quash the impugned suspension order dated 23.11.2023 as illegal, and consequently directing the first and second respondents to reinstate the petitioner in service based on the petitioner's representation dated 10.01.2024, within a time to be stipulated by this Court. 1/4

O R D E R

The writ petitioner challenges the order of suspension dated 23.11.2023 and also requests that the same would be reconsidered on the basis of his representation.

2. The learned counsel for the petitioner would submit that there is absolutely no material whatsoever to state that the load of sand was illegally quarried or transported only on the instructions of the petitioner. It is only the wrongful confession of the accused implicating the petitioner. The respondents without even applying their mind and considering the various aspects, have suspended the petitioner.

3. I have considered the said submissions made by the learned counsel on either side and perused the materials placed on record.

4. On account of the criminal case, the petitioner is suspended only on 2/4
