Respondent PRAYER: Criminal Miscellaneous Petition has been filed under Section 528 of BNSS, 2023 praying to modify the condition in para 7 imposed on the petitioner by the Hon'ble Court in Crl.O.P.No.13585 of 2025 vide order dated 30.04.2025 that the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties (out of which, one shall be a blood related surety), each for a like sum to the satisfaction of the learned Session Judge, Special Court for Trail Cases under SC/ST (POA) Act, Tiruppur.

O R D E R

This Criminal Miscellaneous Petition has been filed to modify the condition imposed on the petitioner by this Court in Crl.O.P.No.13585 of 2025 vide order dated 30.04.2025 that the petitioner is ordered to be released on bail on his executing a bond for a sum of Rs.15,000/- (Rupees Fifteen Thousand only) with two sureties (out of which, one shall be a blood related surety), each for a like sum to the satisfaction of the learned Session Judge, Special Court for Trail Cases under SC/ST (POA) Act, Tiruppur.

2. The learned counsel for the petitioner would submit that the petitioner was granted bail on 30.04.2025, on condition to produce two sureties, out of which, one of whom should be a blood surety. Since, the petitioner belongs to Orissa, he is not in a position to bring his relation from Orissa and on account of that, the petitioner has been in custody for nearly 8 months without availing the bail granted by this Court.

3. Taking into consideration of the entire circumstances and the fact that the petitioner has been unable to come out on bail since 30.04.2025, this Court is inclined to modify the condition to produce two sureties by relaxing the condition in respect of blood surety.
