ORDER

This Writ Petition has been filed seeking for the following two reliefs: (a) To direct the respondents to conduct survey and demarcation of the boundaries of the property owned by the petitioner association, which is morefully described in the affidavit filed in support of this writ petition; and (b) To direct the respondents to exchange the properties owned by the members of the petitioner association with that of the Government.

2. The learned counsel for the petitioner, on instructions, would now submit that for the present, it would suffice if a direction is issued to the respondents to survey and demarcate the boundaries of the properties belonging to the petitioner association.

3. Insofar as the second relief sought for by the petitioner Association, namely, exchange of properties with the Government, is concerned, the petitioner seeks liberty to seek the said relief separately, by filing a separate writ petition, if the need arises, once survey and demarcation of the boundaries is complete over the petitioner's property.

4. Mr. D.Ravichander, learned Special Government Pleader accepts notice on behalf of the respondents.

5. This Court is not expressing any opinion on the merits of the petitioner's representation.

6. No prejudice will be caused to the seventh respondent if the said authority is directed to survey and demarcate the boundaries of the petitioner's property morefully described in the prayer to this writ petition, after hearing the objections if any from the neighbouring land owners as well as any other party,

whom the seventh respondent deems it fit to enquire. Accordingly, this writ petition is disposed of in the following manner:- (a) Before surveying the lands in question, the seventh respondent is directed to issue notice to the neighbouring land owners, and also to any other party, whom the seventh respondent deems it fit to enquire.

(b) After receiving objections if any and after considering the same, the seventh respondent shall conduct survey and demarcate the boundaries of the property morefully described in the prayer to this writ petition, on merits and in accordance with law, within a period of 12 weeks from the date of receipt of a copy of this order. (c) Liberty is granted to the petitioner association to seek for exchange of lands between the petitioner association and the Government separately, by filing a separate writ petition, if the need arises, once survey and demarcation of the boundaries is complete over the petitioner's property. No Costs.
