Writ petition filed under Article 226 of the Constitution of India praying for issuance of a writ of mandamus directing the first respondent to pass orders on the representation submitted by the petitioner on 1.5.2014, against the order passed by the second respondent in Na.Ka.No.165/E/2014 dated 24.3.2014, within a stipulated time.

ORDER

By consent, the writ petition itself is taken up for final disposal.

2.The petitioner earlier, approached this Court by filing W.P.No.2347 of 2014 praying for issuance of a writ of mandamus

directing the Deputy Registrar (Milk), Cuddalore District, to consider his representation requesting for appropriate action preventing the second respondent viz. the General Manager, Villupuram Cuddalore District Cooperative Milk Producers' Union, from carrying on business within the areas of operation of Neyveli Township Milk Consumers' Cooperative Society Ltd., where the petitioner is working as Supervisor/Assistant Cashier, within a time frame fixed by this Court. This Court vide order dated 20.2.2014, has directed the first respondent therein to consider the petitioner's representation dated 14.12.2013, and pass appropriate orders as per the Circular dated 30.8.2013, within a time frame and granted liberty to the petitioner to approach the Registrar of Cooperative Societies (Milk), Chennai also.

3.The first respondent in the said writ petition, who is arrayed as second respondent herein, has passed an order dated 24.3.2014, and aggrieved by the said order, the petitioner submitted an appeal dated 1.5.2014, to the first respondent and according to the petitioner, though it was received and acknowledged, he has not been favoured with any response and hence, came forward to file this writ petition.

4.Heard the submissions of the learned Counsel appearing for the petitioner, Mr.D.Venkatachalam, learned Government Advocate, who accepted notice on behalf of the respondents 1 and 2, and Mr.T.K.Ashok Kumar, learned Counsel, who accepted notice for the third respondent.

5.This Court, taking into consideration the limited scope of prayer sought for by the petitioner and without going into the merits of the claim projected by the petitioner, directs the first respondent to consider and dispose of the petitioner's appeal petition/representation dated 1.5.2014, in accordance with law, after putting on notice, the concerned persons, within a period of eight weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to the persons concerned. The writ petition is disposed of accordingly. No costs.
