ORDER

The petitioner/wife who is the respondent in HMOP No.117 of 2025 has filed the petition seeking transfer of HMOP No.117 of 2025 from the file of Principal Subordinate Court, Vridhachalam to Subordinate Court, Sirkali. 1/4

2. Learned counsel for the petitioner submits that the petitioner is living with four years child without any source of income and as on date, she is living with her parents. Learned counsel also submits that the petitioner finds it difficult to travel from Sirkali to Vridhachalam to attend the court proceedings and therefore has filed the present petition, seeking for transfer.

3. Learned counsel for the respondent/husband submits that the petitioner has given a police complaint and the respondent was harassed by the petitioner's family and therefore, the respondent apprehends to attend the court proceedings at Sirkali.

4. I have considered the submissions of both sides and perused the materials available on record.

5. Considering the facts and circumstances of the case, this Court is inclined to transfer HMOP No.117 of 2025 from the file of Principal Subordinate Court, Vridhachalam to Sub Court, Chidambaram and both the parties are directed to appear before Sub Court, Chidambaram.

Accordingly, Tr.C.M.P.No.244 of 2026 is allowed and the proceedings in HMOP No.117 of 2025 is withdrawn from the file of Principal Subordinate Court, Vridhachalam and the same is transferred to Sub Court, Chidambaram. Since the petitioner is living with four years child, the respondent/husband is directed to pay a sum of Rs.5,000/-(Rupees Five Thousand only) to the petitioner as interim maintenance from July 2026 onwards until modified by Court of law.

7. The Principal Subordinate Court, Vridhachalam is directed to send the entire records relating to HMOP No.117 of 2025 to the file of Sub Court, Chidambaram forthwith.
