This appeal arises against the order of acquittal for the offence under Section 138 of the Negotiable Instruments Act. 2.The learned counsel appearing for the appellant as well as the respondent would submit that the respondent is no more and therefore, nothing survives for consideration in this appeal.

In view of the same, this Criminal Appeal is dismissed as abated.
