ORDER

(1) The petitioner who was arrested and remanded to judicial custody on 21.08.2020 for the offences punishable under Sections 364, 394 read with 397 and 302 IPC in SC.No.94/20217 on the file of the Court of III Additional District and Sessions Judge, Dharapuram, seeks bail.

(2)It is a case of jumped bail. The petitioner is one of the accused in S.C.No.94 of 2017 and that the petitioner did not appear before the Trial Court on 11.02.2019 and as a consequence, NBW was issued against him and the petitioner was arrested 21.08.2020 on execution of NBW and remanded to the judicial custody.

(3)The learned counsel for the petitioner submitted that the petitioner was regularly appearing before the trial Court and thereafter, due to illness he was unable to appear before the Trial Court. The learned Counsel further submitted that the petitioner is in judicial custody from 21.08.2020 and hence, he seeks bail. (4)The learned Additional Public Prosecutor strongly opposes this petition, by stating that the petitioner has got 11 previous cases against him and the earlier bail petitions were dismissed on merits as well as by withdrawal and the petitioner was arrested with great difficulty on execution of Non Bailable Warrant and prays for dismissal of this petition.

(5)Taking note of the fact that it is the case of the year 2017 and the fact that the petitioner has got 11 previous cases against him and also of the fact that the previous petitions were dismissed on 21.01.2021 and 29.03.2021 respectively, this Court is not inclined to grant bail to the petitioner.
