Respondents Writ Petition filed under Article 226 of the Constitution of India praying to issue a Writ of Habeas Corpus directing the respondents herein to produce the body and person of the detenue by name A.Vedha, daughter of Annamalai, aged about 17 years, before this Court and hand over to the petitioner and set her at liberty.

O R D E R

[Order of the Court was made by R.HEMALATHA, J] Mrs.A.Maheswari has filed the present petition for issuance of a writ of Habeas Corpus directing the respondents to produce the body of her daughter A.Vedha, aged 17 years, before this Court.

2. In the affidavit filed along with the petition, the petitioner has contended that her daughter A.Vedha went missing from 16.03.2018. According to her, she searched her daughter and since she could not find out the whereabouts of her daughter, she lodged a complaint with the Inspector of Police, Valathy Police Station, which culminated into registration of First https://hcservices.ecourts.gov.in/hcservices/

3. Notice was issued to the respondents and in response to the notice, the detenue A.Vedha was produced before this Court. We interacted with her. She informed that she was born on 07.05.2000 and that she fell in love with one Ramesh, who was working in a flower shop at Gingee. She also contended that both of them married each other at Mylam Temple on 16.03.2018 and went over to Bangalore where they stayed in one of the friends house of her husband Ramesh till 23.04.2018. It is her further contention that since they did not have money to proceed further in Bangalore they came back to Gingee on 24.04.2018 and both of them were taken into custody by the police at Gingee. She also expressed her willingness to go with her mother .

4. The learned Government Advocate [Crl.side] appearing for the respondents contended that the said Ramesh, aged 25 years, was arrested and remanded to judicial custody. Since the petitioner has expressed her willingness to go with her mother and she being a minor is sent with her mother.
