ORDER
The petitioner, who is facing trial for the offence under Sections 454, 420 and 380 of IPC in C.C.No.97 of 2024 on the file of the learned Judicial Page No.1 of 4
Magistrate No.II, Tirupathur and remanded to judicial custody on 04.12.2023, seeks bail.
2.It is the case of the prosecution that the petitioner used to visit the houses of the victims and posed herself as distant relative and thereafter committed theft of gold jewels and other articles. Hence, the case. 3.The learned counsel for the petitioner would submit that the petitioner is in custody from 04.12.2023 and considering the period of incarceration, she may be released on bail.
5.Per contra, the learned Government Advocate (Crl. Side) has filed a counter affidavit in which he has listed out nearly 59 previous cases of same nature in which the petitioner is an accused, out of which 12 cases have been disposed.
6.The counter affidavit filed by the respondent clearly indicates that the petitioner is an habitual offender. Though the petitioner was arrested on 04.12.2023, this Court is not inclined to release the petitioner on bail as the Page No.2 of 4
petitioner has the propensity to commit similar offences. At the same time, the petitioner cannot be detained for an indefinite period because of the delay in conclusion of the trial. Therefore, this Court is of the view that the Trial Court can be directed to expedite the trial. If the trial is not concluded within a period of six months, the petitioner is at liberty to renew the bail application.
7.With the above observations, these Criminal Original Petition is dismissed.
