ORDER
The State represented by the Inspector of Police, Crime Branch CID, Vellore District, has filed the present petition, seeking to accept the affidavit and extend the time for a further period of four months to complete the investigation of the case and to file final report as per direction given by this Court in its order dated 14.10.2025 made in Crl.M.P.No.18232 of 2025 in Crl.O.P.14086 of 2025.
2. Heard the learned Government Advocate (Crl.Side) for the petitioner and the learned counsel for the respondent and also perused the materials available on record.
3. From the affidavit filed by the Inspector of Police, Crime Branch CID, it is seen that one Nagesh son of Venugopal, who is the owner of a dairy farm, was murdered. On 10.01.2023 at about 22.30 hrs, Nagesh was found dead with multiple cut injuries on the road leading to his residence at Pudur Kollaimedu Village. Based on the complaint, dated 11.01.2023 lodged by his wife Girija, who is the respondent herein, a case was registered in Crime No.9 of 2023 for offence under Section 302 of IPC on the file of Lateri Police Station.
4. It is further stated that despite investigation, the local police were unable to ascertain the motive for the murder, not seized the murder weapon and not arrested the accused. In such circumstances, the complainant/respondent filed Crl.O.P.No.4059 of 2023 before this Court, seeking transfer of the investigation to the Crime Branch CID. By order dated 12.06.2023, this Court transferred the investigation to CBCID. Thereafter, the case was transferred to CBCID, Egmore, Chennai, and was re-registered the First Information Report on 29.09.2023 in CBCID, Vellore in Crime No.3 of 2023 under Section 302 of IPC and taken up for further investigation.

It is also stated that after re-registering the criminal case, the Investigating Officer visited the scene of crime, obtained backup Call Data Records from Vellore District Cyber Cell, examined 49 witnesses and recorded their statements and collected 22 statement of Bank accounts, 32 property documents, 4 two wheeler purchase and subsequent sale details of suspects were collected. The motive behind the murder of V.Nagesh has substantially been established. It was revealed that the deceased had illicit relationship with certain women in neighbouring villages, his business disputes and his earlier conflict with others. All these angles have been thoroughly investigated.

During the course of investigation, the accused have been identified through strong circumstantial evidence, technical evidence and material object evidence, which prima facie establishes their involvement in the commission of the offence. Two persons have already been arrested and third accused has been identified and is likely to be arrested shortly. The vehicle used in the commission of the offence has been identified, and its involvement has been established through investigation. Analysis of Call Data Records (CDRs) and mobile tower locations has been completed, confirming the movement, pattern and presence of the accused in connection with the crime.
7. The learned Government Advocate (Crl. Side) further submitted that since there are no direct eyewitness to the occurrence and the prosecution case rests upon circumstantial evidence, some further time is required for completion of the investigation and filing of the final report. He further submitted that, this Court by order dated 14.10.2025 in Crl.M.P.No.18232, had granted 4 months time to complete the investigation and file the final report. According to him, the investigation is now at the final stage and, therefore, a further period of four months may be granted for filing the final report before the learned Judicial Magistrate III, Vellore.

Considering the submissions made by the learned counsel on either side and being satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this Court is inclined to grant the extension sought for and extend the time for complying with the directions issued by this Court in Crl.MP.No.18232 of 2025 in Crl.O.P.No.14086 of 2025 vide order dated 14.10.2025.
9. Accordingly, this Criminal Miscellaneous Petition stands ordered. The time for complying with the order dated 14.10.2025 passed by this Court in Crl.O.P.No.14086 of 2025, is hereby extended by a further period of four months from the date of receipt of a copy of this order.
