This Application has been filed to condone the delay of 152 days in filing the written statement of 1st and 2nd defendants in the above suit. 2.Learned counsel appearing for the respondents would have serious objections and would submit by stating that no reasons have been assigned in the application to condone the delay.

3.I have perused the affidavit filed in support of this Application. The reason assigned by the applicant is that there was delay in getting documents from the plaintiff and immediately on getting those documents, he had instructed his counsel to file the written statement and the same had caused the delay.

4.Considering the averments made in the affidavit filed in support of this application and being satisfied with the reasons stated in the same, the delay is condoned and this application is ordered accordingly. However, there shall be on order as to costs.
