Respondents PRAYER: Writ petition filed under Article 226 of the Constitution of India praying for issuance of Writ of Mandamus to direct the 2nd respondent to consider and pass orders on the representation of the petitioner dated 10.08.2017 in regard to survey of the petitioner's land situated at Plot No.3, Jamunabai Street, Sembium, Chennai-11 in T.S.No.12/1C & 1/1D to the extent of 2430 sq.ft. As per the Survey and Boundaries Act, 1923, within a reasonable time.

2. Heard both sides.

The petitioner seeks for a mandamus directing the 2nd respondent to consider and pass orders on the representation of the petitioner dated 10.08.2017 with regard to survey of the petitioner's land situated at Plot No.3, Jamunabai Street, Sembium, Chennai-11 in T.S.No.12/1C & 1/1D to the extent of 2430 sq.ft. As per the Survey and Boundaries Act, 1923, within a reasonable time.

4. The grievance of the petitioner before this Court, is that the said representation has not been considered so far. This Court, at this stage, is not expressing any view on the claim made by the petitioner, as it is for the 2nd respondent to consider and decide the same. Thus, this writ petition is disposed of, only with a direction to the 2nd respondent to consider the representation of the petitioner dated 10.08.2017 and pass orders on the same on merits and in accordance with law, after hearing the rival claimants, if any. Such exercise shall be done by the 1st respondent within a period of eight weeks from the date of receipt of a copy of this order. No costs.
