A.No.1796 of 2022 in C.S.No.12 of 2020 KRISHNAN RAMASAMY, J., This application has been filed seeking to condone the delay of 763 days in filing the written statement of D7, D8, D9 and D12 in C.S.No.12 of 2020.

2.The learned counsel appearing for the applicants/defendants 7 to 9 & 12 submitted that he could not file written statement in time due to Covid-19 pandemic situation. He further submitted that during Covid-19 pandemic, the Hon'ble Supreme Court has extended time limit from time to time in respect of matters pertains to limitation and in fact there was absolutely no delay much less 763 days, but only 6 days delay in filing the written statement. Therefore, he seeks to condone the delay. 3.The learned counsel appearing for the 1st respondent/plaintiff made a formal objection to allow the present application. 4.Considering the submission made by the learned counsel and being satisfied with the reasons stated in the affidavit filed in support of the application and in the interest of justice, this Court is of the view that the delay needs to be condoned.

KRISHNAN RAMASAMY, J., rst 5.Accordingly, the delay is condoned and the application is allowed.

6.Registry is directed to take the written statement on file, if it is otherwise in order. The learned counsel appearing for the applicants 7 to 9 & 12/defendants is directed to serve the papers to the learned counsel appearing for the plaintiff.

7.The other defendants are directed to file written statement on or before 04.07.2022.

Post the matter on 05.07.2022.
