Writ Petition filed under Article 226 of The Constitution of India praying to issue a Writ of Declaration to declare Rule 5 of the Special Rules for the Tamil Nadu Forest Subordinate Service Rules as amended in G.O.Ms.No.76 Environment and Forests Department dated 10.07.2014 insofar as fixing Educational qualification as any decree including Science or Engineering for the purpose of recruitment to the post of Forester by direct recruitment is concerned as ultra vires and consequently to direct the respondents to fix the qualification for appointment to the post of Foresters by direct recruitment as Bachelor Degree of Science (Forestry) and consequently, to direct the respondents to give preference to the Bachelor of Science (Forestry) Degree Holders in the matter of recruitment in the light of the recommendation made in National Forest Policy 1988 and National Forest Commission 2004 within the period.

Mr.M.Purushothaman, learned counsel on record for writ petitioner submits that the captioned main 'Writ Petition' {hereinafter 'WP' for the sake of brevity} has become infructuous, saying so, learned counsel submits that he has instructions from writ petitioner to withdraw the captioned WP. Learned counsel has made an endorsement in the case file in this regard and a scanned reproduction of the endorsement is as follows:

4. In the light of the narrative thus far, captioned WP is dismissed as withdrawn. Consequently, connected miscellaneous petition is closed. There shall be no order as to costs.
