Writ Petitions filed under Article 226 of Constitution of India to issue a Writ of Mandamus to direct the respondent to process the application dated 05.11.2016 and the subsequent compliance report dated 03.03.2017 submitted by the petitioner for grant of approval for General Purpose Rating Course from the academic sessions commencing from 01.07.2017 by causing necessary inspection and further processing the application in accordance with norms and merits, within a time frame to be fixed by this Court.

O R D E R

The petitioner seeks for issuance of writ of mandamus directing the respondent to process the application dated 05.11.2016 and the subsequent compliance report dated 03.03.2017 for grant of approval for General Purpose Rating Course from the

academic session commencing from 01.07.2017 by causing necessary inspection and further processing the application in accordance with norms and merits.

2. Heard Mr.G.Sankaran learned counsel appearing for the petitioner and Mr.T.V.Krishnamachari, learned Senior Panel Counsel for Central Government appearing for the respondent.

3. The grievance of the petitioner is that their application filed for grant of approval for General Purpose Rating Course has not been considered by the respondent so far, even though a compliance report was filed on 03.03.2017.

On the other hand, the respondent has filed a counter affidavit and stated that the petitioner has been asked to produce three documents, namely (i) Valid QMS Certificate (ii) Placement details of candidates (iii) Audited account for the last preceding three years. Thus, it is stated that the respondent has not processed the petitioner's application for want of production of those three documents. The respondent further stated that they would process the application of the petitioner, provided they produce the above said three documents. Learned counsel for the respondent also reiterated the contentions raised in the counter affidavit stating that the petitioner's application will be processed only when those three documents are produced before the respondent.

Considering the above stated facts and circumstances, this Writ petition is disposed of by directing the petitioner to produce those three documents before the respondent within a period of seven days from the date of receipt of a copy of this order. On receipt of those documents, the respondent is directed to process the application of the petitioner and pass orders on merits and in accordance with law within a period of four weeks thereafter. No costs. Consequently, connected miscellaneous petition is closed.
