These applications have been filed to amend the Judges summons by deleting the word" garnishee" and to amend the prayer in E.P.Nos.11 and 12 of 2024.

2. These applications are opposed by the first respondent/Award Debtor primarily on the ground that if these applications are allowed the appeals have been filed against order dated 26.02.2024 before the Hon'ble Division Bench of this Court will be rendered infructous.

3. The learned counsel for the second respondent appears and submits that the second respondent cannot sell share. The learned counsel for the second respondent however would submit that it can transfer the shares as may be recorded.

4. The objections raised by the first respondent/Award Debtor are technical in nature. The amendment proposed to the Judges summons in A.No.1658 of 2024 in E.P.No.11 of 2024 and A.No.1659 of 2024 in E.P.No.12 of 2024 will not finally determine the inter se rights of either the Applicant/Award Holder or the first respondent/Award Debtor finally at this stage.

5. I therefore do not see any legal impediment in allowing these applications for amending the Execution Petitions. Accordingly, these applications for amending the Judges summons stand allowed . 21.03.2024 kkd Note : Applicant is directed to carry out necessary amendment in these E.Ps.
