Criminal Appeal filed under Sections 374 r/w. 386 r/w Section 27 of Code of Criminal Procedure to set aside the judgment and order passed by the learned III Additional Special Judge, Chennai in C.C.No.20 of 2005 on 13.08.2010 convicting the appellant herein for offences under (1) Section 7 and (2) Section 13(2) r/w. 13(1)(d) of the Prevention of Corruption Act, and directing the appellant to undergo a sentence of 2 years rigorous imprisonment and to pay a fine of Rs.3,000/- in default to undergo 3 months simple imprisonment for each of the offences, acquit the appellants.

JUDGMENT
When the Criminal Appeal was taken up for hearing on 11.11.2016 and 15.12.2016 there was no representation for the appellant either in person or through counsel. Hence, the matter was posted 'for dismissal' on 19.12.2016. Again, on 19.12.2016 also, there was no representation for the appellant. Hence, for giving one more opportunity to the appellant, the matter was directed to be listed under the same caption on 20.12.2016.
Today, when the matter was called in the morning session, there was no representation for the appellant and the same was passed over. Again, in the evening session, when the matter is called there is no representation for the appellant. Hence, the Criminal Appeal is dismissed for non-prosecution.
