Prayer: Criminal Original Petition is filed under Section 482 of Criminal Produce Code to modify the condition imposed by the learned Principal Sessions Judge, Namakkal, order dated 06.02.2020 made in C.M.P.No.2073 of 2019 "(i) the petitioner shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh Only) before the Jurisdictional Tahsildar as non-refundable deposit. After receipt of the above said amount, the same will have to be deposited by the Tahsildar, to the credit of the District Mines and Minerals Foundation Trust as non-refundable deposit".

ORDER

(The case has been heard through video conference) The petition has been filed to modify the condition imposed by the learned Principal Sessions Judge, Namakkal, by order dated 06.02.2020 made in C.M.P.No.2073 of 2019 that the petitioner shall deposit a sum of Rs.1,00,000/- (Rupees One Lakh Only) before the Jurisdictional Tahsildar as nonrefundable deposit. https://hcservices.ecourts.gov.in/hcservices/

2. Heard the learned Counsel for the petitioner and the learned Additonal Public Prosecutor appearing for the respondent police.

3. Taking into consideration the submissions made by the learned Counsel, the condition No.1, imposed by the learned Principal Sessions Judge, Namakkal, by order dated 06.02.2020 in C.M.P.No.2073 of 2019 that the petitioner shall deposit a sum of Rs.1,00,000/- before the Jurisdictional Tahsildar as non-refundable deposit is modified to the effect that the petitioner shall deposit a sum of Rs.50,000/- (Rupees Fifty Thousand Only) before the Jurisdictional Tahsildar as non-refundable deposit and all other conditions will remain the same.
