PRAYER: This criminal miscellaneous petition has been filed under Section 528 of the B.N.S.S, to modify the condition in order dated 29.10.2024 in Crl.M.P.No.3834 of 2024 to the extent of instead of reporting daily 10.30 AM for 30 days as monthly once.

ORDER

The petitioner seeks modification of the condition in Crl.M.P.No.3834 of 2024 dated 29.10.2024 imposed by the Judicial Magistrate No.1, Poonamallee, that the petitioner shall appear and sign before the respondent's police station everyday at 10:00 a.m., for a period of 30 days.

The learned counsel for the petitioner submitted that the petitioner's son, who was born recently on 07.11.2024 has become ill and hence, he could comply with the conditions only for 20 days. 3.

The learned Government Advocate (Crl. Side) confirmed the fact that the petitioner has complied with the conditions for 20 days. 4.

Considering the submissions of both sides, in view of the aforesaid fact, this Court is of the view that the condition imposed on the petitioner in Crl.M.P.No.3834 of 2024 dated 29.10.2024 is modified as follows:

"The petitioner shall appear before the respondent police once in a week, viz. Saturday, at 10:00 a.m., until further orders."

The other conditions imposed in Crl.M.P.No.3834 of 2024 dated 29.10.20245 shall remain unaltered.

4. Accordingly, the criminal original petition is ordered, and the condition is modified.
