ORDER

By consent, the writ petition itself is taken up for final disposal.

2.The petitioner, claiming to be a resident of Koonattampettai village, would submit that he belongs to Erular community, which has been designated as Scheduled Tribe community. In his village, ward election took place in the year 2011 and one T.D.Srinivasan has contested the election in respect of Ward No.1, which has been specifically designated as reserved ward for Scheduled Tribe community. The said person has produced a certificate as if he belongs to Konda Reddy community (Scheduled Tribe) and won the https://hcservices.ecourts.gov.in/hcservices/

election. On coming to know that he does not belong to the said community, the petitioner submitted a representation dated 16.03.2015 to the first respondent praying for appropriate action and also submitted a representation to the State Election Commission, which in turn, returned the application stating that he has to approach the jurisdictional District Collector. The grievance expressed by the petitioner is that in spite of the representation dated 16.03.2015, no action has been taken and hence came forward to file this writ petition.

3.Heard the submissions of the learned counsel for the petitioner and Mr.V.Subbiah, learned Special Government Pleader, who accepts notice on behalf of respondents 1 and 2.

4.This Court, taking into consideration the limited scope of the prayer sought for by the petitioner, without entering upon the merits of the claim, directs the first respondent to consider the representation of the petitioner dated 16.03.2015, after putting on notice Mr.T.D.Srinivasan, District Panchayat Member and pass orders in accordance with law, within a period of six weeks from the date of receipt of a copy of this order and communicate the decision taken, to the petitioner as well as to Mr.T.D.Srinivasan. The writ petition is disposed of accordingly. No costs.
