Respondents Prayer : Writ Petition filed under Article 226 of Constitution of India praying for the issuance of a Writ of Certiorarified Mandamus to call for the records on the files of the third respondent pertaining to its proceedings in Na.Ka.No.Ya1/2225/2023 dated 16.03.2024 to quash the same and

consequently direct the respondents to permit the petitioner to continue her service as Warden in the Government ADW Firls Hostel (Annex-II) Veppery, Chennai.

ORDER

This Writ Petition has been filed challenging the order of transfer in proceedings in Na.Ka.No.Ya1/2225/2023 dated 16.03.2024 passed by the third respondent.

2. Heard the learned counsel appearing on either side and perused the materials available on record.

3. The petitioner had joined as BT Assistant in the Adi Dravidar Welfare High School, Achampatti, Madurai District, on 10.08.2005 through Tamil Nadu Public Service Commission. Thereafter, she was transferred from Royapuram Government ADW PG to Research Boys Hostel to Government ADW Girls Hostel (Annex-II) Veppery, Chennai as Warden on 03.03.2023. Now, by an order dated 16.03.2024, the petitioner has been transferred to Government ADW Middle School, Nanthivaram, Chengalpattu.

4. The learned counsel appearing for the petitioner would submit that the petitioner is a widow and has two children and that she was not able to

travel to Nanthivaram, Chengalpattu, daily to attend the School. Therefore, the petitioner submitted a representation to reconsider the order of transfer dated 16.03.2024.

5. Though this Court is not inclined to interfere with the order of transfer dated 16.03.2024, the third respondent is directed to consider the representation submitted by the petitioner, only after she joins in the transferred place, on merits and in accordance with law.

6. With the above direction, this Writ Petition stands disposed of. Consequently, connected miscellaneous petitions are closed. No costs. 22.03.2024 Internet: Yes Index : Yes/No Lpp To
