PRAYER: Writ Petition filed under Article 226 of the Constitution of India to issue a Writ of Mandamus, directing the respondents to pay interest at the rate of 8% per annum on the delayed payment of Provident Fund, Gratuity, Surrender of Earned Leave Salary, Commuted Pension and other retirement benefits payable to the petitioner's husband for the period from 30.06.2024 to 02.12.2025 i.e., 521 days.

ORDER
The writ petition is filed for the relief set out below: "directing the respondents to pay interest at the rate of 8% per annum on the delayed payment of Provident Fund, Gratuity, Surrender of Earned Leave Salary, Commuted Pension and other retirement benefits payable to the petitioner's husband for the period from 30.06.2024 to 02.12.2025 i.e., 521 days."

It is the case of the petitioner that her husband who was employed under the first respondent-Corporation and holding the post of Section Officer Accounts, had retired from service on 30.06.2024, on attaining the age of superannuation. It is the further case of the petitioner that her husband passed away on 31.08.2025. The respondents had settled all the retiral benefits only on 02.12.2025 with a delay of more than 1 1⁄2 years. Therefore, the respondents are legally bound to pay interest for the delayed settlement. The petitioner has made a representation dated 05.03.2026 to the respondents to pay the interest at the rate of 8% p.a., for the delayed payment of retirement benefits such as 2/5
Provident Fund, Gratuity, Surrender leave Salary and Commuted Pension etc., Since the same was not considered to date, the petitioner is before this Court. 3.
The learned Standing Counsel for the first respondent would fairly submit that they are willing to pay the interest at the rate of 6% per annum for the belated payment of the eligible and admissible amount.
4. Heard the learned counsel on either side and perused the materials available on records.
5. Admittedly, the Earned Leave Salary, Gratuity Amount, Provident Amount and Commuted Pension etc., has been paid to the petitioner's husband belatedly, for no fault of his. Therefore, the petitioner's husband is entitled to the interest on the same. Therefore, a mandamus is issued directing the respondents to disburse the 6% interest for belated payment of Earned Leave Salary, Gratuity Amount, Provident fund and Commuted Pension etc., within a period of one six weeks from the date of receipt of a copy of this order. 3/5
