C.M.P.No.7904 of 2023 in C.M.A.SR.No.40842 of 2023 N.MALA,J, This petition is filed to condone the delay of 298 days in filing the above C.M.A.SR.No.40842 of 2023.

2. It is seen that the notice sent to the 1st respondent was returned as "refused". The 2nd respondent though served with notice has not appeared through counsel.

3. I have gone through the affidavit filed in support of this petition and I am of the view that the delay of 298 days is condoned on condition that the petitioners shall forfeit the interest for the delay period of 298 days and this petition is accordingly ordered.
