The Official Liquidator, v. Nil

This application has been filed seeking to recall the order dated 19.01.2018 passed by this Court, where inter alia this Court passed the following order:

"There is no representation on behalf of the petitioners. Though the name of the Special Government Pleader is printed in the cause list, there is no representation on his behalf.

2. When the matter is taken up for hearing, learned Official Liquidator would submit that no orders are required as about 30,000 depositors are being paid dividend. He would further submit that the learned Administrator has already been discharged.

3. In view of the above, the company petition is closed as no further order is required. However liberty is given to the Official Liquidator to file appropriate application, if so required."

2. Learned Official Liquidator submits that there is still a sum of Rs.7,30,56,636/- is available in the company account. Since the group of 1/3

companies have been wind up, he would fairly submits that the said amount have to be distributed among the other creditors.

3. Learned Official Liquidator further submits that unless the company petition is alive, he is not in a position to disburse the amount.

4. In view of the above, this Court is inclined to recall the order dated 19.01.2018. That apart, the learned counsel appearing for the applicant prayed for some cancellation of the entries in the Sub-Registrar office. Hence, the order dated 19.01.2018 is recalled.
