The present miscellaneous petition has been filed seeking to condone the delay of 135 days in preferring the Criminal Appeal before this Court against the judgement dated 09.08.2023 in S.T.C.No.859 of 2021 on the file of the XIV Metropolitan Magistrate, Small Cause Court, Chennai.

2. Heard Mr.S.Suresh, learned counsel appearing for the petitioner and Mr.P.Murali, learned counsel appearing for the respondent.

3. Having satisfied with the reasons stated in the accompanying affidavit filed in support of this petition, this petition stands allowed.

4. Registry is directed to number the Criminal Appeal, if the papers are otherwise in order and list the same for admission.
