2. None appears on behalf of the first respondent despite service.

3. Mr.P.Muthukumar, learned Government Pleader appears for the second respondent and has no objection to condone the delay in filing the appeal.

4. We have considered the application for condonation of delay and find justified reason to condone the delay of 130 days of filing the appeal and otherwise none is there to oppose the application.

5. In view of the above, the delay is condoned and the application is ordered.

The Registry is directed to number the appeal, if it is otherwise in order.
