This Criminal Original Petition is filed by the father alleging that the complaint given by his wife regarding kidnapping of minor daughter and registered in Crime No.69 of 2023 on 23.08.2023 is liable to be 1/4

quashed in the light of the Division Bench order passed in HCP.No.1809 of 2023 dated 20.11.2023.

The learned Government Advocate (Crl.Side) appearing for the respondent police submits that the petitioner and the 2nd respondent have two children, earlier a complaint was given regarding the custody of his son and that reached finality after order passed in HCP filed by the petitioner. Thereafter, the custody of the daughter was forcibly taken by the petitioner herein and therefore, a case in Crime No.69 of 2023 been registered and under investigation. The subsequent development in this case and the orders passed by the Division Bench in HCP referred above been taken by the Investigating Officer and appropriate decision will be taken.

Recording the same, this Criminal Original Petition is disposed of with direction to the respondent police to complete the investigation within a period of 45 days from the date of receipt of a copy of this order.
