This application has been filed under Order XIV Rule 8 of Original Side Rules read with Order I Rule 8 of the Code of Civil Procedure seeking leave of this Court to institute the present suit against the third respondent/third defendant, representing the interest of all its members.

2. It is represented by a learned counsel that some objectors have filed application. However, the same is not in record.

3. Heard the learned counsel and perused the records.

4. The defendants have not raised any objection for grant of leave to sue. On a careful perusal of the averments made in the plaint, this Court is satisfied and hence, the applicants are entitled to file the suit under the representative capacity and the leave is granted. Accordingly, this application is allowed.

5. Registry is directed to take the suit on file, if it is otherwise in order.
